The Party Wall etc. Act 1996

The Act provides a framework for preventing and resolving disputes in relation to party walls & structures, boundary walls and excavations near neighbouring buildings.

We can provide advice on the various rights and obligations imposed on owners by the Act and prepare and serve the relevant notices on your behalf and prepare appropriate awards.

The CDM Regulations 2007 / CDM Co-ordinator services

Many construction projects fall within the scope of the Construction (Design & Management) Regulations 2007. These regulations define and impose specific obligations and responsibilities for managing health & safety on various parties to a construction project. For projects which are notifiable to the Health & Safety Executive, the regulations require the appointment of a competent CDM Co-ordinator prior to undertaking any design work.

As a registered CDM Co-ordinator and member of The Association for Project Safety (APS), Oakleaf's principal surveyor is able to advise on the implications of the CDM Regulations, both on clients and contractors, and also undertake the role of CDM Co-ordinator. We can prepare pre-tender health & safety plans and compile health & safety files in accordance with the regulations.

Landlord and tenant

Most forms of commercial property leases contain expressed covenants, which impose obligations on both the landlord and tenant to repair and maintain the property. We can provide professional advice in respect of these obligations and act on behalf of a party to a lease to try and enforce such obligations and resolve any disputes arising.

We can also provide advice to landlords and tenants in relation to alterations proposed to a leased property, and seek appropriate consents where these are required under the terms of the lease.

Building pathology

We can offer advice on the causes and possible remedy of specific building defects and problems.

As well as undertaking defects investigation and analysis, we can arrange for defects monitoring, testing and if necessary, the specification and supervision of subsequent remedial work.

Boundary disputes

We can make detailed investigations and gather impartial evidence regarding boundary and demarcation disputes. Which if necessary, can be prepared for use as Expert Evidence.

Insurance reinstatement valuations

In order to ensure that the cover offered by your buildings insurance is adequate, regular re-appraisal of the value of reinstatement works should take place.

We are able to undertake valuation of reinstatement works and provide full design & project management services for remedial works.
